By purchasing insurance, User acknowledges and certifies that all information provided is accurate and truthful.  The submission of false, fictitious, or fraudulent information may result in imprisonment of up to 5 years and a fine of up to $10,000 (18 USC 1001).  Furthermore, a civil penalty of up to $5,000 and an assessment of twice the amount falsely claimed may be imposed (31 USC 3802). Any fraudulent claims will make the shipper and/or consignee liable for any prosecution for mail fraud under federal crime code.

ACCESS ELIGIBILITY

MoveInsure ("MoveInsure") has developed its website ("Site") to serve and assist cargo owners, shippers, consignees or representatives of cargo interests ("Users") with their cargo insurance requirements, both for personal and business shipments.

MoveInsure offers users of its Site the ability to insure goods in transit online. Users may obtain quotations, issue policies for single trip transit risks, process premium payments and notify claims – all online. The Site also offers general information and documents for perusal and comparison to assist Users in the management of their cargo insurance needs.

Users are free to access the MoveInsure Site, but by doing so agree to the terms and conditions set forth herewith.

AMENDMENTS

MoveInsure may at any time and at its sole discretion, change, add, modify, or remove any part of this Agreement by posting a new Agreement to its Site. Users who continue to use the Site after changes have been posted shall be deemed to have agreed to such changes.

LIMIT OF LIABILITY

MoveInsure endeavors to provide its Users with reliable and timely information, and may occasionally alter, change, improve, and update information without prior notice. JURISDICITION AND APPLICABLE LAWS

The MoveInsure Site (excluding third-party linked sites) is controlled by MoveInsure from its office in the State of New York . Since the Site can be accessed from other countries around the world whose laws may differ from those of the State of New York, each User shall ensure that the transaction of insurance business through MoveInsure does not place the User, Broker, or participating Underwriters in breach of any insurance or other applicable laws and regulations in the User’s own jurisdiction. MoveInsure makes no representation that materials on the website are appropriate or available for use in other locations and accessing them where illegal is prohibited. When accessing the Site from another location, Users do so on their own initiative and are responsible for compliance with local laws.

The user and MoveInsure agree that the use of this website and any service purchased as a result, or through the use, hereof shall be governed in all respects solely and exclusively by the laws of the State of New York, U.S.A. without regard to conflict of laws principles thereunder. The user and MoveInsure expressly consent, and submit, to the exclusive jurisdiction of the courts of the United States and the courts of the State of New York, and it is stipulated that sole and exclusive venue shall be in New York, New York for the adjudication or disposition of any claim, action or dispute arising out of the use of this website and any service purchased as a result, or through the use, hereof.

Failure by MoveInsure to exercise or enforce any right or provision of the terms of service shall not constitute a waiver of such right or provision. MoveInsure does not collect any personal information about its Users other than that, which is voluntarily provided, i.e. when Users (a) apply for an insurance policy, (b) send and transmit email information, and (c) submit credit card details. In the event that other personal information is collected elsewhere on the Site, Users will be informed accordingly.
